Oregon bans the over-the-counter sale of synthetic cannabinoids

Oregon will become the first state in the Union to ban synthetic cannabinoids starting in July.

Oregon regulatory authorities (Oregon Liquor and Cannabis CommissionOLCC) said they were restricting the over-the-counter sale of these products due to concerns about the chemicals used in their manufacture.

What are synthetic cannabinoids?

Cannabinoids are compounds found in cannabis. Different chemical processes make it possible to isolate them but also to create them synthetically in abundant quantities.

The Farm Bill of 2018, which legalized hemp at the federal level in the United States, allowed for easier extraction of cannabidiol (CBD), often used as a starting point to synthetically recreate natural cannabinoids present in minute quantities in the hemp plant.

As synthetic cannabinoids are derived from hemp and are not accompanied by THC (or below the legal limit of 0.3%), they are almost unregulated and can be sold freely, especially in supermarkets, stations -service and other retailers. However, some states have begun to ban their sale due to health risks and lack of controls for synthesis and before sale.

The best-known synthetic cannabinoid in the United States is delta-8 THC, popular because it reproduces the effect of THC at a lower potency, not without risk. The Centers for Disease Control warned consumers last year that there were more than 100 exposures to delta-8 that required hospitalization in just six months nationwide in 2021.

Delta-8 or delta-10, like CBD and CBN, occur naturally in hemp. However, since they exist in very small quantities, an acid chemical process is used to extract it from the CBD.

“The supply of CBD exceeded the demand for CBD,” said Steven Crowley, hemp compliance and processing specialist at the OLCC.

“And so people who had CBD on hand were looking for other ways to market it. People started working on different products that they could turn CBD into. This is how delta-8 THC products are obtained. »

The ban comes into effect in July, but from July 2023 the sale of synthetic cannabinoids will be allowed in cannabis stores authorized by the OLCC – which therefore have a license to sell cannabis – and after the products have undergone rigorous and costly testing and received approval from the FDA, the US food authority.

Biden administration reviews cannabis and DCR policies

Rahul Gupta, director of the US Office of National Drug Control Policy (ONDCP), the drug control body attached to the Oval Office, discussed several changes in US drug policy in an interview published on Wednesday. speak FinancialTimes.

The “Drug Czar” explained that the Biden administration is “monitoring” states that have legalized cannabis to potentially reevaluate federal policy, acknowledging the failures of the prohibitionist approach.

He also said the federal government is considering broader proposals for drug harm reduction, including allowing supervised consumption sites — even going so far as to suggest possible decriminalization. 107,000 Americans died of drug overdoses last year.

“We are learning from these states [qui ont adopté une réforme du cannabis] said Gupta. “We are monitoring the data and trying to see where things are going. But one thing is very clear, and the president has been clear about it – the policies we’ve had around cannabis haven’t worked. »

President Joe Biden has campaigned on a cannabis platform of decriminalization, rescheduling, respecting states’ rights and other modest reforms, though he remains opposed to legalizing adult use and has yet to taken meaningful action on its previous promises.

In this new interview, Rahul Gupta, who advised a cannabis company before working in the White House, also pointed out that with regard to general drug policy, “for the first time in history, the federal government adopts specific risk reduction policies”.

And he specifically argued that people “shouldn’t be incarcerated, arrested, just for their drug use. »

While the Biden administration is still studying the clinical effectiveness of Safer Drinking Sites (SCMRs), Rahul Gupta said the proposal to lift the existing federal ban is on the table.

New York City opened the first harm reduction centers late last year, with 59 overdoses averted in the first 3 weeks of operation. Rhode Island’s governor signed a landmark bill last year to establish a pilot SCMR program.

Earlier this month, a California Assembly committee approved a bill passed by the Senate that would establish a pilot program allowing certain jurisdictions in the state to authorize safe consumption sites where people could consume drugs. currently illicit in a medically supervised environment.

According to a poll released in April, a majority of Americans (64%) support allowing safe drinking sites.

The Call of 18 joints is this weekend!

While the heat will be in full swing this weekend throughout France, the traditional 18 joints event will be held in Paris and Poitiers to denounce “the hypocrisy and social violence caused by the repression” of drugs in general and cannabis in particular.

This rally will celebrate the 29th anniversary of the International Day for the Legalization of Cannabis, and wishes to denounce “the politics of numbers” totally ineffective and counterproductive.

It will also be an opportunity to pay tribute to Eric Chapel, founder of the PAKA ‘n Cie Association and the first Chanvre et Cie store in Montreuil, an emblematic figure of the pro-hemp movement in France who recently disappeared, and to commemorate the disappearances of Mathieu “Onyrix” and Philippe “Phix”, pro-cannabis activists who also left too soon.

According to the organizers, “it is urgent to demand the decriminalization of the use of psychotropic drugs and the reform of the French law of December 31, 1970. For the right to self-produce for domestic use, generalized access to cannabis at medical aim, the regulation of the cannabis market to get out of the total failure of the policy in force for 52 years”.

Quebec cannabis producer Hexo to lay off 450 employees

New blow for the former Quebec flagship. The cannabis producer announced a net loss of 146 million Canadian dollars (108 million euros) for the February-April quarter, i.e. a loss of 953.8 million Canadian dollars (707 million euros) for the first nine month of its 2022 financial year.

The turnover of the Quebec company fell by 14% to reach 45.6 million Canadian dollars in the third quarter.

“The company now believes that it will not realize the synergies and incremental cash flow increases at the level estimated in its previous guidance and it expects these numbers and metrics to be lower than previous guidance,” noted Hexo in a press release.

Hexo had previously pledged to be the only major Canadian cannabis producer to be cash flow positive and had propelled itself as Canada’s 3rd largest recreational cannabis producer following the takeover of one of its competitors, Redecan.

The Quebec company said it was reducing its workforce by 450 positions, which is expected to result in cost savings of C$30.6 million. At the same time, Hexo has spent C$7.8 million on severance pay for big executive jobs this year.

HEXO is committed to streamlining its operations across all functions. This allows our best-selling brands to remain competitive in the marketplace while aligning with our long-term financial goals. We look forward to sharing additional details in our third quarter results the company told MJBizDaily.

The rapprochement with Tilray is mechanically changed. Hexo’s debt will now be converted at a price of C$0.40 per share, approximately half of the $0.85 per share previously agreed. Shares of the company were trading at around C$0.21 at the time of writing on the Toronto Stock Exchange.

The changes could eventually give Tilray up to 50% Hexo, up from an estimated 35%.

“The strategic partnership with Tilray Brands significantly improves HEXO’s capital structure and provides the opportunity to accelerate our growth in global markets,” Charlie Bowman, President and CEO of Hexo, said in a statement.

“Tough stock market conditions necessitated changes to the agreement, but this is a critical step to unlocking the shareholder value held by the company. »

The Brazilian Superior Court of Justice approves the self-cultivation of cannabis for medical purposes

Brazil’s Superior Court of Justice last Tuesday authorized three patients to cultivate cannabis for medical purposes, a decision that should be applied nationwide in similar cases.

A panel of five judges from the country’s Superior Court of Justice unanimously ruled that the three patients could grow cannabis. The cases in question mainly concerned the extraction of cannabidiol to relieve their pain. Brazilian law currently limits the medical use of cannabis-derived products to imported products.

The Brazilian Ministry of Health has not yet regulated home cultivation of cannabis for medical purposes.

Justice Rogerio Schietti said the Supreme Court panel acted because the government failed to take a position on the matter.

Religion and the far right

“The discourse against this possibility is moralistic. It often has a religious character, based on dogma, false truths, stigmas,” Judge Schietti said. “Let’s put an end to this prejudice, to this moralism which delays the development of this question at the legislative level, and which very often obscures the minds of Brazilian judges. »

Judge Antonio Saldanha said “there is a deliberate retrograde move towards obscurantism” in the Brazilian government’s delay.

President Jair Bolsonaro, a far-right politician facing an uphill battle for re-election in October, said in June 2021 that he disagreed with any permission for Brazilians to grow cannabis at home, regardless of their objective.

Former President Luiz Inacio Lula da Silva, the main leader of the left-wing Workers’ Party, is leading all opinion polls to regain the post he held from 2003 to 2010, and favors legalizing the cannabis.

Over 800,000 Thais have registered to grow cannabis at home

Since June 9, Thais have the right to grow cannabis at home, officially for medical purposes.

The procedure for registering a plantation could not be simpler: people wishing to cultivate at home must register on PlookGanja, a government web interface also available as a mobile application available on the Android and iOs stores. If this is not possible, they can also go to the provincial administrative offices to file their application and wait to receive their notification of acceptance.

Thus, yesterday at 5 p.m. local time, more than 800,000 people registered their application for legal planting according to the count of the Thai Cannabis FDA, a division of the Ministry of Health which partly regulates the public use of cannabis.

PlookGanja

About half of the 800,000 applications have already been accepted.

In parallel, the Thai government has committed to distributing more than 1 million Cannabis plants. Thais will thus be able to cultivate cannabis and resell it to the local medical circuit made up of pharmacies and dispensaries via the intermediary of the regulatory authority.

“This will enable the people and the government to generate more than 10 billion baht [par an, soit 300 millions €] income from cannabis and hemp. (…) During this time, people can present their cannabis and hemp related products and sell their products throughout the country. explained Anutin Charnvirakul, Thai Minister of Health.

The sale of recreational cannabis is not yet legal in Thailand, and its public consumption still punishable by imprisonment and fines, but some stores, notably in Bangkok, have already started selling cannabis “for adults”.

The rules related to recreational use should be published quickly by the Thai government, cannabis is currently neither illegal – it is no longer a narcotic – nor legal – it is not yet regulated. Only cannabis extracts (oils, concentrates, etc.) with +0.2% THC are currently only reserved for the pharmaceutical circuit.

Legalization of cannabis in Germany: the consultation process begins

The German government has announced today that it is starting the first of five expert hearings aimed at preparing the regulation of cannabis in Germany.

In total, more than 200 of the leading experts in addiction medicine, drug treatment, law, business and associations, as well as representatives of the Länder, municipalities, federal ministries and of the federal authorities, will exchange their points of view on the central issues. International experts will also speak.

Five hearings are scheduled until the end of June and will focus on:

  • Health and consumer protection
  • Youth protection and prevention
  • Supply chains, ecological and economic issues
  • Penalties, Controls and Licensing to Accompany the Introduction of Controlled Distribution of Cannabis for Recreational Purposes
  • International experiences

Burkhard Blienert, German Drugs Commissioner, said: “The time has come: we are entering the preparatory phase for legalization! Finally being able to announce it is a special moment for me, a moment of joy. Like many others, I have worked for years so that we in Germany finally stop criminalizing cannabis users and start building a modern, health-oriented cannabis policy. The hearings should make it possible to discuss the measures which will make it possible to guarantee the best protection of young people, health and consumers in the event of implementation. Because one thing is clear: we particularly want to protect children and young people from potential risks.”

The promise to legalize the controlled sale of cannabis to adults in licensed shops is part of a series of reforms included in the coalition agreement struck last year between the three social-liberal parties that make up Chancellor Olaf Scholz’s government. .

Scholz’s coalition took office in December. In early May, Health Minister Karl Lauterbach said he planned to draw up a draft legalization in the second half of the year, following expert hearings.

The government campaign to legalize cannabis has been named “Cannabis – aber sicher”, “cannabis, but safe”.

Illinois diversifies its cannabis industry

Illinois granted 48 new home-grown cannabis licenses last week, continuing the slow progress of expanding and diversifying its cannabis sector, which sold $1.4 billion in 2021.

20 of these new licenses are majority-owned by blacks, 17 by whites and 4 by Hispanics, with the rest being held by a group of people or without specific information.

All new licensees qualify as social equity seekers, which means they live in areas of high poverty, face frequent cannabis-related arrests, or members of their immediate family have a minor cannabis-related criminal record or that more than half of their employees meet these criteria.

Companies that have been awarded a license can now obtain funding to pursue their project and acquire their growing space, hire employees or even buy equipment.

“This is really good news,” attorney Don Craven, who represents several licensed companies, told the Chicago Tribune. “It adds a level of certainty that they didn’t have before.”

Many growers expect it to take 6 months to 1 year to open, at a minimum. Of the first batch of 40 craft cultivation licenses authorized in 2021, only 3 have recently received permits to begin construction.

With these 48 new licenses, almost half of the 341 growers, transport companies and artisanal processorsedibles above all) authorized by the State Department of Agriculture are companies with a majority of diversity.

Illinois law limits craft growers to 450 square meters of grow space, a fraction of the original 20,000 square feet of grow space allowed for the original grow licenses.

The artisanal growers hope that the new legislation will increase their size limit, which would also make it easier to obtain financing, the yield was mechanically better with a larger area.
